DeedsCounty clerk of the county where the land lies (elected; acts as register of deeds). The clerk records deeds, mortgages and other instruments and keeps a grantor-grantee general index and tract-style abstract records.1No statewide per-page amount: a county clerk may charge a reasonable copy fee that may not exceed the actual cost of duplication (materials and supplies only, no labor or overhead). Example: Laramie County $0.50 per printed page, $1.00 per page emailed.1

Public records law in Wyoming

Wyoming Public Records Act (W.S. 16-4-201 through 16-4-205) Read the law10

This law covers records that agencies hold, such as a county office's correspondence or a property file. Recorded deeds, vital records and court files usually have their own rules, set out in each record section.

Who can ask
Any person; no residency requirement or statement of purpose in the Act. Applications are written, though the designated public records person may accept a verbal request.10
Response time
Readily available records must be released immediately; if records are not held by the agency or are in use/storage, the requester must be notified within 7 business days of acknowledged receipt; all records must be released within 30 calendar days of acknowledged receipt unless good cause exists, in which case a mutually agreed release date applies.10
Copy fees
No fee may be charged just to inspect. Copies: a reasonable fee set by the custodian, but only if authorized by statute, rule, resolution, ordinance or similar authority; specific statutory fees (e.g., county clerk and court clerk fees) apply where they exist. Electronic records: requester bears reasonable cost of producing the copy, which may include programming/computer services.11
If a request is refused
Ask for a written statement of the grounds of denial (must cite the law). Then either file a complaint with the governor-designated Public Records Ombudsman (mediation, can set release timelines and waive fees) or petition the district court where the record is found for a show-cause order. Knowing or intentional violations carry a civil penalty up to $750.12
What is exempt
Mandatory denials (16-4-203(d)) include medical/psychological data on individuals, adoption and welfare records, most personnel file contents, letters of reference, trade secrets, hospital records, student records, library patron records, 911 data, income tax return data, workers' compensation claim records and some peace officer recordings. Discretionary denials (16-4-203(b)) include law-enforcement investigative files, test questions, pre-acquisition appraisals, inter/intra-agency memoranda and security plans. Inspection is also barred where contrary to state/federal law or court rule/order.12

How Wyoming organizes its records

  • In smaller counties (other than first- and second-class), the elected county clerk is also ex officio clerk of district court, so deeds, marriage licenses, elections and court files may sit in one office17
  • No public statewide online court case search: public access terminals (PASS) at clerks' offices show cases from all courts3
  • UCC: Secretary of State is the main filing office, but vehicle security interests are filed with county clerks (unusual)18
  • Public Records Ombudsman (Governor's Office) mediates records disputes but cannot compel action19
  • Voter lists are only for political use (not commercial) and only for listed political requesters20
  • Laramie County Clerk offers a free Document Alert (via iDoc Market) to warn owners of new recordings against their name/property (deed-fraud protection)21
