Public records law in Nevada

Nevada Public Records Act (NRS Chapter 239 (NRS 239.001 et seq.)) Read the law11

This law covers records that agencies hold, such as a county office's correspondence or a property file. Recorded deeds, vital records and court files usually have their own rules, set out in each record section.

Who can ask
Any person11
Response time
Not later than the end of the 5th business day after receiving a written or oral request, the entity must provide the record, say in writing it lacks custody (and name the custodian), give written notice of the earliest date it will be available, or deny in writing citing the specific confidentiality statute; readily available records must be provided as expeditiously as practicable11
Copy fees
Copy fee may not exceed the actual cost to the entity unless a specific statute or regulation sets the fee; entity must post its fee list; may waive fees by written policy; law-library copies max 50 cents/page; GIS data may include additional reasonable costs (NRS 239.054)11
If a request is refused
No administrative appeal; requester may apply to the district court in the county where the record is located if a request is denied, unreasonably delayed, or the fee is excessive; court gives the matter priority; prevailing requester recovers costs and reasonable attorney's fees; entity bears burden of proving confidentiality by a preponderance of the evidence11
What is exempt
Records are open unless declared confidential by law; NRS 239.010(1) cross-references more than 580 specific NRS sections that make records confidential; exemptions are construed narrowly; confidential parts must be redacted rather than withholding the whole record. Examples: vital records disclosure limited (NRS 440.170), voter SSN/driver's license numbers and e-mail (NRS 293.558), criminal history beyond convictions (NRS 179A)11
Official guide
Official guidance: 'Nevada Public Records Act: A Manual for Executive Branch Agencies' and NAC 239, listed by the Nevada State Library, Archives & Public Records (which prescribes request forms with the Attorney General under NRS 239.008); the AG's own page only explains how to request AG records12

How Nevada organizes its records

  • Carson City is a consolidated municipality treated as a county: its Clerk is ex officio Recorder (Clerk-Recorder holds both deeds and clerk records), and with Storey County it forms the First Judicial District.1
  • Marriage certificate custodian differs by county: in Clark County (population 700,000+, ordinance under NRS 246.100) certificates are filed with and copied by the County Clerk; elsewhere they are recorded by the County Recorder (e.g. Washoe).1
  • Clark and Washoe have county health districts that issue birth and death certificates locally (Southern Nevada Health District; Northern Nevada Public Health), with different fees from the State office.8
  • Clark County district court records are kept by the Eighth Judicial District Court Clerk of the Court (not the County Clerk's office, which handles marriage and business services).14

Warnings from official sources

  • Nevada Attorney General alert (Aug 26, 2009, still posted by Clark County Recorder): companies mailing homeowners offers to obtain a copy of their deed (e.g. National Deed Service, $59.50); deeds can be obtained from the county recorder for much less.33
  • Clark County Recorder: companies not affiliated with the Recorder charge far more for copies; the Recorder charges $1.00 per page and $4.00 to certify and never solicits sales of certified copies.34
  • DPBH Office of Vital Records: fraudulent third-party websites charge high fees to 'process' birth, death, marriage and divorce certificates; VitalChek is the only online vendor; complaints to AG Bureau of Consumer Protection (702) 486-3132.35
  • DPS Sex Offender Registry: scam calls to registered offenders demanding fines for non-compliance/warrants; DPS and local law enforcement do not collect money for these.20

Official copies vs look-alike sites

A certified copy comes only from the office that holds the record; reports and "research copies" sold by commercial sites are not issued by any Nevada office. How to tell an official record source from a paid look-alike.
