- What is public
- Courts are outside FOIA and follow their own access rules. Family Court files can be reviewed in the courthouse Records Room in the presence of staff with photo ID; social documents (psychological evaluations, social histories, presentence and custody investigations) need a judicial order.4
- Sealed and confidential records
- Criminal records may be expunged through the State Bureau of Identification: $72.00 application; if a mandatory expungement is approved, a $75.00 money order to the Delaware State Police; otherwise the applicant receives information on the discretionary expungement process.5
Older records and indexes
- Older records
- Older court records (e.g. divorce decrees, pardons) may be at the Delaware Public Archives; copies of divorce decrees from DPA are $10.00 each.6
