Public records law in West Virginia
West Virginia Freedom of Information Act (WV-FOIA) (W. Va. Code § 29B-1-1 et seq. (Chapter 29B, Article 1, 'Public Records')) Read the law11
This law covers records that agencies hold, such as a county office's correspondence or a property file. Recorded deeds, vital records and court files usually have their own rules, set out in each record section.
- Who can ask
- Every person (no residency or purpose requirement stated); request goes directly to the custodian and must state with reasonable specificity the information sought12
- Response time
- As soon as practicable but within a maximum of 5 days (not counting Saturdays, Sundays or legal holidays): furnish copies, set a time and place to inspect, or deny in writing with reasons12
- If a request is refused
- A person denied access may sue for injunctive or declaratory relief in the circuit court of the county where the record is kept; de novo review, burden on the public body; a person who successfully brings the suit recovers attorney fees and court costs from the public body (§ 29B-1-7)13
- What is exempt
- Presumption of access; § 29B-1-4(a) lists specific exemptions incl. trade secrets; personal/medical files where disclosure is an unreasonable invasion of privacy; test questions; law-enforcement investigative/internal records; information exempted by other statutes; undeveloped archaeological site locations; financial-institution exam reports; internal memoranda; terrorism/security records; and more (e.g., concealed weapon license applications, anonymous lottery winners)14

Probate records and wills in West Virginia
- Who holds it
- Clerk of the county commission (County Clerk): wills are delivered to the clerk and probated by the county commission or its clerk10
- Copy fee
- County clerk copy fees apply: $1.50 per document, $1 per page beyond two, $1 seal2
How this works in other states: probate records and wills by state.
How West Virginia organizes its records
- County commissions (not courts) handle probate: wills are delivered to and probated by the clerk of the county commission, so probate records are at the County Clerk, not the circuit clerk.17
- Family court files (divorce, custody) are confidential except orders and indices; physical files are kept by the circuit clerk.7
- Assumed/trade names are filed statewide with the Secretary of State; § 47-8-2 names no county DBA filing.18
- Sheriffs are the county property tax collectors.19

Warnings from official sources
- WV Attorney General (2014) warned of official-looking 'Recorded Deed Notice' letters from Record Transfer Services selling deed copies for $83; homeowners are not obligated to pay and can get copies from the county clerk for much less. Consumer Protection hotline 1-800-368-8808.34
- Vital records online orders: only through third-party vendors; the state receives $12 per copy regardless of vendor fees.8
Official copies vs look-alike sites
A certified copy comes only from the office that holds the record; reports and "research copies" sold by commercial sites are not issued by any West Virginia office. How to tell an official record source from a paid look-alike.
